UPDATE: Facebook clamping down on fake news – doesn’t include the Mail, Sun or Express: Facebook claims UK introducing blue passports after Brexit vote is fake news
Interesting to see the Daily Mail’s Brussels correspondent David Churchill continuing the long tradition of Fleet Street journalists prepared to lie through their teeth to further the political ends of their proprietors.
But David has really been pushing the boat out.
This week, David produced an article about children supposedly being banned from writing to Santa by EU regulations.
The only thing wrong with it? Well, just about everything:
David wins our coveted ‘Best Journalist At Getting The Most Lies In The Smallest Space Possible Award‘.
Well done David!
.
Here’s an article debunking David’s story:
EU data protection rules do not ban Christmas wish lists – in Bavaria or elsewhere

I completely understand why he (David Churchill) might want to encourage this though. I’m certain he doesn’t like any competition in telling the greatest porkies and, let’s face it, Santa is just another bloody lie. For most of us, of course, it’s over by the time we reach secondary school – he clearly not only believes his own garbage peddled out in the Hate onLine, but also that Santa still exists bless him.

The European Commission state:
‘Contrary to reports in the Daily Mail (German children banned from sending their wish-lists to Santa…because of EU privacy laws, 22 November 2018), the EU’s General Data Protection Regulation does not forbid Christmas wish lists.
Under EU data protection rules, data can be processed when a person has given their consent but also on the basis of other legal grounds. In this context, Santa Claus should have the contact details of a family in order to deliver presents on the wish list he received – in the case of minors, provided their parents agree. These have been the rules for the past 20 years and the General Data Protection Regulation has not changed them. Also provisions for the protection of minors reflect national civil law.
As for the Bavarian town of Roth referred in the article, all seems good – the city council has confirmed their Christmas tree wish list tradition is going ahead as usual.’
So although there is an online story on a German site which appears to be the source of the Mail’s story both are clearly wrong and one must wonder on the motive behind them.

“We are no longer accepting comments on this article.” – Once the EU actually publishes a complete rebuttal, the Daily Fail decides to prevent their readership actually getting to know that their article is a complete load of hogwash. And it has the audacity to claim the EU is a dictatorship.
What is the Daily Mail actually scared of? Oh yes, its readership discovering that it’s a propaganda & hate filled paper that makes the work of Goebbels look positively ineffectual. Remind me again, wasn’t it the Daily Mail that supported the Nazis before WW2? Nasty little infection that needs wiping out before it destroys more minds in this country..

We live in Germany … as EU says, it is a matter of consent… and as parents, we’re very glad that those wishing to publish, share or hand over to others personal details such as our address, tel. etc must first seek permission to do so. Alpha Mail at its worst. Appalling – and desperate from folk who can’t stand the idea that half of Britain doesn’t agree with the Brexit bollox – and no May campaign or anything else is going to change that. Meanwhile, children in Germany will be sending their letters to Santa in the usual way this year and for many to come, with no impediment from the EU or anyone else.

The misinformation seems to have originated with the German site, Antenne Bayern. I contacted them and they did indeed hold an “Aktion “ to save Christmas for the children of Roth. I shared their link above. So while it is false in this case it doesn’t come from the mail itself. I remember my mum having to give consent for things like this in the 80s so the new law hasn’t changed anything in that respect.

Actually both the Mail and Antenne Bayern are both wrong. The najority opinion on the site below is that Santa is either exempt from the GDPR, or else has been compliant with it since before the EU came into existence. Perhaps the Mail and Antenne Bayern should be told that they needn’t worry. 🙂

On the bright side the Mail updated the article on the 28th November to accommodate the actual facts that children wouldn’t be banned from putting out their Christmas wish-lists. Although one has to get to the end of the article to read it.

Just spare a thought for the poor jurist who got a magna cum laude PhD in law, landed a job at the European Parliament and… Had to pen that page explaining why the GDPR doesn’t prohibit Santa from doing his job.
I’m pretty sure that’s not what that guy or gal signed up for.
