This real-life account by a throat cancer victim of the misery caused by ATOS and the bedroom tax speaks for itself:
“Please feel free to share my story wherever you think it may do some good, though for now I’d prefer it if you withhold my name.
Five years ago, I was diagnosed with throat cancer. 12 weeks worth of drastic Radio and chemo therapy eradicated the tumour but left me almost dead through various complications including streptococcal, pneumonia and the dreaded hospital infection.
I lost over half my bodyweight and all my muscles and tendons became almost useless due to wastage brought on by the treatment.
I have now been fighting to gain weight and become healthy but it’s difficult as the treatment has left me unable to swallow solid food and I have had to have all my teeth removed.
I have recently been diagnosed with another side effect of the cancer treatment called Osteoradionecrosis. It is a possible complication following radiotherapy. Irradiation of bones causes damage to osteocytes and impairs the blood supply. The affected hard tissues become hypovascular (reduced number of blood vessels), hypocellular (reduced number of cells) and hypoxic (low levels of oxygen). Osteoradionecrosis is the term for when the area of bone does not heal from this damage. This usually occurs in the mandible, and causes chronic pain and surface ulceration.
We have tried just about everything available to us to try to slow down the degradation of my lower jaw but the specialist now feels that we have no other option but complete removal & replacement of the lower Jaw.
This entails promoting extra new bone growth to the lower leg, then sculpting that bone and using it to replace the jaw,
As you can imagine, this should be a terrifying prospect and as I am still very under weight and weak from the initial treatment and the continuing other side effects such as constant infections and bouts of pneumonia, The chances of surviving such a long and complicated procedure are not favourable but the chances of having my lower jaw suddenly collapse and crumble on me are so high that it’s been decided the operation must be performed as soon as possible.
Last week I went for my final CT scan to the legs to enable the specialist to decide where to anchor and proceed with the new bone growth, and in two weeks time we are meeting with the entire care team to discuss times, dates, procedures and after care etc.
Throughout the entire time, my youngest son has acted as my live in carer and despite of all the hard work that involves he has managed over those five years to get his required GCSE results, complete and pass with distinction a two year Extended Diploma in engineering, undergone more vocational training and has now started to work for himself from home. Why? So that he can continue to care for me.
So where am I going with this? Well let me see, you would think, would you not, that with fighting this damned disease for the last five years, worrying about my sons future prospects and thinking about what’s about to happen to me, you’d be forgiven for thinking that I’ve enough on my plate to worry about right? ….
Wrong. For the last five years I have had to fight and struggle for every penny of benefit. I applied for DLA which took three years to get to tribunal, who instantly granted it, apologised to me and my son for the way we’d been treated by ATOS and the DWP, ordered them to pay 3 years worth of back pay and I thought all would be ok. … Not so, at the earliest opportunity, they stopped my DLA saying it had run out? They took me off incapacity benefit and put me in the ESA Work Group? … Really? I can hardly stand up most days let alone get to work and now they have stopped my appeal to be transferred from the WRAG to the support group without explanation.
On top of all of this, me and my son have fallen foul of the bedroom tax. I have lived in my home for over 30 years. My three sons grew up here and went to the local school. My second son who also supports me when he can, and my little grand daughter live just around the corner, Most of my friends and my support network live in or around the village, I have spent thousands of pounds and hundreds of man hours over the years turning what was a scruffy old 1930’s council house and a jungle of a garden, into a comfortable and pleasant to be in home with a garden designed to relax and as it happens, aid recovery.
My local HA does not have any 2 bed housing stock available, after my operation, I am going to need a live in carer for a while at least (assuming I survive the process) and the council are taking in excess of £10 a week out of my Council tax benefit for an alleged overpayment because we didn’t inform them when my son who lives with me became non dependant. An oversight as opposed to deliberate fraud I hasten to add. So now I am in a situation where the costs of benefit over payment claw back from both the council and the HA, the 15% bedroom tax, and the reduction of council tax benefits. I am now actually expected to pay out more than I have coming in in benefits, and that’s before we think about electric, heating food etc. Not once has there been any mention of the hundreds of thousands of pounds my son has saved them in care costs for me, as, had he left home and left me to my own devices, they would have been responsible for!
Having told my specialist, (luckily one of the countries top maxofacial surgeons) all about this when he enquired into why I was looking so rough and still not putting on any weight, his reply was interesting and not an angle that had previously come to me, he said “ Good god what is the point? We spend quite literally hundreds of hours, and hundreds of thousands of health service pounds on curing you and trying to ensure you are capable of enjoying some quality of life, and those Inglorious Ba****ds wipe out all our hard work with the swipe of a pen” … a very good point in my opinion!
So, far from preparing myself both mentally and physically for the rapidly approaching medical procedures, I am left worrying myself to death about what will happen to us when this all hit’s the fan as it inevitable will as I cannot pay them what they are asking for. I have made it quite clear to the HA that the only way they will get me out of my home is in a wooden box so do your worst, but I am worried sick that they may try to evict my son whilst I am in hospital to such an extent that I have, far from gaining and getting fit, started to lose weight and strength again and the situation has done nothing but exasperate my depression and anxiety attacks.
My one fervent wish now is that one day, in the not too distant future that all of those responsible, and all of those who have supported the outrage that is the welfare reform act, are brought to justice and made to pay for their inhumanity!
Both my father, and my grand father were highly decorated war heroes, I myself have served my country bit within the MoD and the Civil Service. I’m sure they and their comrades are crying in their graves, this is not the England they fought and died for!
I wish you all well in your endeavours. The time has come for us all to set aside our petty differences and rise up with one voice to put these criminals behind bars where they belong!

For some reason that David Icks crazy “they are all reptiles” theory doesn’t seem quite so crazy when you see time and time again these “people” in government destroying life and families without a thought.
We need to organise some direct action groups that will protest and blockade any future evictions for people like this. In america after Zuccotti park alot of the Ocuppy people went on to fight house foreclosures in the same way. We need to do the same. We cannot let people worry themselves literally to death because of government evil.

The telegraph, independent and times are, too, celebrating the royal birth. Disabled people don’t even get a mention here.
What is wrong with this country ? – the nazis are winning. Social cleansing is rapidly progressing under the full glare of government design and the people can’t/ don’t even see what’s happening. I couldn’t help but breakdown in floods of tears and I’m not ashamed to admit it, I read another heartbreaking story last night about a poor lady who had suffered from being 15 with a brain tumour, she was called in for an assessment and was told to prepare for going back to work as an Atos plonker had assessed her as being fit for some type of work, the poor lady’s cancer began to grow again and she died within a few weeks, leaving a family devastated and wondering why and how is this possible in this Britain of today. I have dropped the Great because it is no longer relevant in this bloody pathetic excuse for a country. I am deeply ashamed that as yet I haven’t took any direct action to try and force these murdering scum into some type of reversal of the policies that are having such a terrible effect on the very people we should be devoting more resources to. This week of action is my chance to get involved and hopefully ease this tormented feeling of guilt through inaction. I apologise to the good people and their families who have been so terribly wronged by this shower of s**t, if we had been more radical, we may have done something, I don’t know what but it certainly doesn’t help. If when I am in London for the mass march, I see any of them, I will do my upmost to see if I can shorten their life or lives preferably as they have done to people far more deserving to still be here than the disgusting life form resident in and around London and are known to many as Tory scum.

Yesterday I was saddened to read the death of a mum after ATOS found her fit to work. It is right that ATOS are investigated but we also must remember that none of their awful actions could be got away with without the complicit support of DWP.
For nearly 14 years I was employed by the Benefits Agency, the Invalid Care Allowance Unit for many of them. Lets not forget DWP and government have long history of discrimination. Without the European Court of Human Rights it is obvious this and other governments in the UK will erode peoples rights. It was the ECHR that said married women could claim Carers Allowance as in the early 80′s only men and single women could claim. A Mrs Drake, a married woman took on the government on, went to Europe and won saying that married women were being discriminated against. The ECHR agreed.
Margaret Thatcher’s government were forced to pay thousands to hundreds of thousands of married women of Invalid Care Allowance over over the UK. After all, they were caring for loved ones too as many of you are now.
So DWP/Government have a long history of discriminating. Unfortunately, usually under a Tory government.
As we hear of deaths of more and more people after they are found fit to work because of ATOS and DWP and can put my hand on my heart and say :-
“I am thoroughly ashamed of my past association with DWP.”

paul8ar…it is eyewateringly clear where the dwp believe the problems to be, not enough assessors and poor writing skills of atos…although the tests themselves are claimed to be ok…there was only ever one purpose for setting up the current wca regime and that is to find more people fit for work, as they claimed using the old method too many people were found unfit for work, even though at the time there could have been no evidence of this.

Atos have been left reeling after two severe blows to their survival as providers of medical assessments in the course of a week. First, a government audit has found that their work capability assessments are so poor that not only must all their current health professionals undergo retraining but also new providers are to be brought in to break up the Atos monopoly by next summer.
Second, an upper tribunal judge has ruled that the opinion of a physiotherapist – on whom Atos are heavily reliant both for carrying out WCAs and even more so for PIP medicals – is of no value if the claimant has a mental health condition. The ramifications of this decision could be huge.
Meanwhile, GPs in South Wales have been told by their local governing body to always refuse to provide letters for claimants in connection with benefits claims as it is ‘an abuse of the national health service’. Only requests by the DWP will be met in future.
Elsewhere, rumours that the software for universal credit has had to be scrapped and started afresh continue to grow. It is looking more and more likely that there will be no genuine rollout of universal credit before the next general election.
ATOS LOSES MONOPOLY
Atos healthcare is to lose its long-held monopoly stranglehold on work capability assessments (open access) from next summer. The news comes as the DWP revealed that 41% of sampled Atos reports had achieved only a ‘c’ grade in a recent audit.
Atos has been the only provider of work capability assessment medicals for employment and support allowance and of its forerunner, the all work test for incapacity benefit, since DWP medical services were outsourced. Campaigners have long argued that the assessments carried out by Atos were not of an acceptable standard but, up until now, the DWP have always defended Atos as if they were part of the same department.
Now, however, the government has decided that Atos is not up to standard and that an improvement plan has to be put into place. Measures include retraining and re-evaluating all Atos health professionals, bringing in a third party to assess Atos’ own audits of its work and engaging Price Waterhouse Coopers to provide advice on improving quality assurance.
ATOS PHYSIO’S EVIDENCE OF NO VALUE
Atos could be in even more difficulties following an upper tribunal decision that the opinion of an Atos health professional who is a physiotherapist was of “no probative value whatsoever” where it concerned a claimant who had a mental, rather than physical, health condition.
The case involved a claimant who had been placed in the WRAG but had appealed to be placed in the support group. The claimant’s mental health conditions included depression and bouts of uncontrollable rage. The judge stated that:
“I can only express my surprise that in a case where the only issue was the mental health of the claimant and its effect in relation to the mental health descriptors, the report was prepared by a physiotherapist following a 15 minute interview. It is plainly important that questions of mental health should be assessed by a disability analyst with appropriate mental health qualifications if their opinion is to be of any evidential value. Even then tribunals should beware of placing too much weight on such reports, based as they are on a very short interview with a claimant and without access to medical records.“
Although the decision, which was highlighted on the Rightsnet discussion forum for welfare rights workers, relates to ESA there is no logical reason why similar arguments cannot be employed in relation to PIP, where a very similar points based system is in place. This could pose a massive problem for Atos whose successful bid for the PIP medical assessment contract stated that they would be using the following health professionals:
933 physiotherapists
373 nurses
75 occupational therapists
19 doctors.
There seems little doubt that the DWP will appeal the decision. Meanwhile, however, we’ll be updating our ESA appeals guide in the near future to take account of this decision – and to look at the potential advantages and risks of using it in your own appeal.

[Sorry FinkFurst – I didn’t realise we were in some kind of race or competition here that could be won or lost. I thought we were having a conversation about the harrowing way disabled and sick people are being treated in this country.
As for whether this personal account is true or not – of course it’s possible it’s just made up. This could be my next-door neighbour and you could still claim it was made up. I personally don’t believe it is. Mainly because I have seen literally hundreds of personal accounts very similar to and just as harrowing as this one. 32 people are dying every week after being assessed as fit for work by ATOS. Many many more people – hundreds of thousands – are suffering because of the bedroom tax too. This is my evidence. So even if you choose to disbelieve this account – you would have to choose to disbelieve all the others too. You clearly have an agenda here. And it’s pretty glaring.] – Tom

My opinion is that contracting Work Capability Assessment to ANY commercial organisation is a fundamentally flawed concept, but posting and defending an unverifiable (and in my opinion rather dubious) personal account is counter-productive, as well as it being dishonest to state it to be true in the absence of any evidence.
