(not satire – it’s the UKIP!)
Ho hum. Another week and yet another threat of being sued.
This time the threat’s from a UKIP activist – which is a bit strange for a so-called libertarian who’s supposed to be in favour of less state interference in people’s lives.
Well actually – on that theme – if there’s one thing annoys me more than anything else it’s a bunch of right-wing Thatcherite authoritarians trying to make out they’re libertarians. After all – I can’t think of anything less libertarian than wanting the government to decide who you can and can’t get married to – can you?
No – UKIP are about as libertarian as I’m a catwalk model.
This latest threat of libel comes from UKIP activist Marty Caine – who seems to be a bit upset about me pointing out that he labelled the family of Drummer Lee Rigby ‘idiots’ after they released their very moving statement for calm.

If you scroll down the comments in that blog post – you’ll see Marty’s announcement that he’s going to sue me along with two other people as well as presumably anyone else who repeats the fact that he labelled the family of Lee Rigby ‘idiots’.
A word of advice Marty.
If you don’t want anyone to know you called the Rigby family idiots – don’t call them idiots in the first place.
And if you can’t help yourself because your mouth is bigger than your brain – just apologise profusely and withdraw the comment.
It’s a lot cheaper than suing. And losing.

Delightful though it is to have a new serious political challenger in the mix, exactly how serious they’ll be seen in the run-up to the next general election remains to be seen. Marty Caine’s labelling of drummer Lee Rigby’s family as ‘idiots’ for calling for calm after his murder is a case in point.

Given that I’m one of the people who originally screenshotted and tweeted Marty’s little brainspew, I presume I’m one of the three people he’s “preparing to sue”.
Funnily enough I’m not worried. Not least because
(a) he doesn’t have my address, and I’m certainly not going to give it to him so he can post me a vexatious lawsuit
(b) I somehow doubt Marty has the funds of Lord McAlpine.
Oh, and
(c) he doesn’t have a case.
Here’s interesting thought from my I-am-not-a-lawyer brain. The tweet that I sent out included the original screenshot, so people could see his exact wording. That screenshot promptly went viral, with large numbers of people clearly agreeing that “Marty Caine thinks the Rigby family are idiots” is a reasonable interpretation of what he said. One could presumably therefore argue that the way it went viral is in itself a refutation of his claim that I distorted his words in a defamatory way.
I strongly doubt there’ll be an opportunity to test this argument in a court of law, but if it does, rest assured I’ll be billing Marty for the costs.

Unfortunately this kind of behaviour will become more common following the legally wrong outcome being reached in McAlpine v Bercow. It sent out a very bad and wrong message that disproportionate and vexatious litigation will succeed.
I have come across probably dozens of posts on the internet from people threatening to sue others since for name calling etc. Personally I feel that vexatious individuals making threats and pursuing actions should be restrained by Civil Restraint Orders. Perhaps Tom could apply for one here if the threat escalates any further.

The original comment that I quoted was mainly an attempt to portray the UKIP as authoritarian, but obviously you hadn’t got enough of an attention span to read what the blog is about.
It does have to be about the Muslims if you are trying to ‘think of anything less libertarian than wanting the government to decide who you can and can’t get married to’ because unless the aggresive rise of Islam is stopped in this country there will be tyranny and Muslims already decide who their offspring get married to, usually a first cousin brought here from Pakistan.
The only political party who will stop Sharia law in it’s tracks if elected is the UKIP which is the party that many contributors who reply here seem scared of and are trying to tarnish.
Will gay marriage be allowed under the Sharia?
You’ll soon find out if Labour are elected.

Well for those of you who truly believe there is no case to be answered please consider how you would react if the same thing was ever done to yourself.
The problem here is not the screenshot taken and then posted on twitter as some cheap shot to try and embarrass someone. What Phil Dore and IBT’s Timur Moon did was to take it that extra level. You could retweet that screenshot all day long and there is nothing that I, nor anyone else could do but they created a story from the screenshot and give it an over exaggerated headline which they knew full well to be a lie, they did this for no other purpose than to damage my reputation. If anyone thinks that is not a case of defamation then please feel free to look up ‘Malicious Falsehood’ it may actually save you from making the same mistake.
So please do continue Tom, you are without doubt helping me far more than you are helping your friend Phil.

I think you had better send it to Phil Dore because without it he is unlikely to prove that an ex soldier such as I, would even contemplate offending a grieving family of a murdered soldier, in fact you have got to be pretty sick to even twist something into that and attempt to make it go viral but then looking at some of the information I am currently being sent about this particular Cardiff keyboard warrior, it really does not surprise me at all.

Having being a victim of defamation of character myself by government agencies, I would not wish it on my worst enemy, but even if you are innocent as you claim, there is very little redress for you in the British courts unless you have loads of money to pursue that claim.

I often try to defend UKIP on this and other message boards but I have to be honest and say that for whatever reason you’ve made a mistake.
You have raised your head above the parapet by publicly declaring your support for UKIP, and if you didn’t already know it you now know that the looney left will do whatever it takes to discredit you and silence you.
Your tweet stated that ‘like all idiots’ etc; and although you probably never intended to insult or show disrespect to Lee Rigby’s family you appear to have made the mistake of writing in a conversational style which is very much open to interpretation.
Those who oppose your views have interpreted your tweet in such a way as to show you in the worst possible light, that’s what happens when you raise your head above the parapet.
You are known as a UKIP activist, so you and everybody else who supports or endorses UKIP will be constantly sniped at, your every utterance will be minutely examined and any mistake that you make will be given the widest possible publicity.
Don’t take it personally, learn from it and come back stronger.
You have been ridiculed on this message board and I confess that I’ve had a bit of fun at your expense, but your threats to sue are meat and drink to bloggers, satirists and people like myself who take the piss a bit now and then.

Have you noticed that they always prefer to preach to their own kind?
They feel safer in numbers attacking a lone voice which opposes them, but their ideological stupidity doesn’t stand close scrutiny which is why they have no option but to supress all discussion and debate about their anti-English dogma.
They’ve been prattling on about how wonderful mass immigration is and how wonderful and fluffy Islam and their multi-culti claptrap is for donkey’s years, but it’s plain to see that there is an overwhelming body of public opinion who oppose their views, even more so since the vicious brutal murder of Lee Rigby has shown the Islamist threat into sharp focus.
The mainstream political parties are impotent and cannot or will not stem this rising tide which is eroding our freedoms and changing our way of life.
Nigel Farage has spoken words which have been well received by ordinary people all over England, so the left have no choice other than to discredit him and anyone who agrees with him or they’re finished.
Don’t fall into the trap of compounding your original mistake with the threats of legal action which make you look immature and are confirming to your detractors that they have scored a direct hit.
You did make a mistake, so take it on the chin and take the fight back to the looney left, instead of appearing to be on the defensive and providing them with more ammunition with which to snipe at you.
Get off your back foot and have a look at some of the many examples when the left has spectacularly failed to cover themselves in glory, God knows there are more than enough examples to choose from.

I would just like to clarify that my character assassination was nothing to do with child abuse or anything like, but that I was made to look like a liar when my benefits were sanctioned by the various government and social agencies they brought in to interfere in my life for no good reason.

Well although long winded and in parts almost interesting, you could not have been any further of the mark if you had tried. I am not going after Phil Dore because of twisting something I had said, taking a screenshot and then posting that on twitter, I am doing it because he knowingly and deliberately lied about me, with a total and complete disregard for a grieving family of a dead soldier, this also caused enough problems to cause emotional stress to my wife. Now you may well be the type of week minded individual, that doesn’t really care too much about other people but I am not.

Usually I’m against this sort of misinterpretation. But you’ve done yourself no favours with all this flapping about. To answer your question – if I had made the same mistake as you, and became the subject of this reaction, I’d probably do a little blog post to clarify what I meant, and apologise.
I wouldn’t try to sue everybody in sight.
